Church of the Apostles Waiver and Release of Liability

1. By signing this Waiver and Release of Liability (Agreement), I waive and release Church of the Apostles, its agents, servants, employees, insurers, successors and assigns from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including but not limited to claims for personal injury, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence or involvement at the facility. I hereby assume all of the risks of participating and/or volunteering in this event. This waiver and release is intended to and does release Church of the Apostles from any and all liability for damages or injuries on account of or in any way related to or growing out of my negligence, the negligence of third parties and Church of the Apostles’ negligence. This is not intended to release Church of the Apostles from any liability resulting from their intentional conduct. I further covenant and agree not to institute any claims or legal action against Church of the Apostles for any claim released by this Agreement. I further agree that should any claim be made against church of the Apostles in contravention of this Agreement, including but not limited to derivative claims, I will protect, defend and completely indemnity (reimburse) Church of the Apostles for any such claim and expenses including attorney’s fees and costs incurred by Church of the Apostles in defending themselves or security indemnity hereunder.

2. I understand that Church of the Apostles is not responsible for any lost, stolen, or damaged valuables or property.

3. I certify that I am physically fit and have sufficiently trained for participation in the event and have not been advised otherwise by a qualified medical person (if applicable to event type).

4. I acknowledge that I have received and read a copy of the current rules and regulations governing the use of the facility. I agree that I will fully comply with all rules and regulations and with any amendments. I have read the Agreement and understand that by signing the Agreement I have consented to be bound by its terms, including the waiver/release of any legal right I may have to sue Church of the Apostles for any costs they incur because a claim or legal action is brought in violation of this Agreement. I agree any violation of the Agreement and its terms and conditions, as determined by Church of the Apostles, will void and terminate this Agreement and may result in loss of the ability to use the facility.

The waiver and release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I acknowledge that this waiver and release form will be used by the persons or entities being released in the activity or event listed above and that it will govern my actions and responsibilities in said activity or event.

PARENT / GUARDIAN WAIVER FOR MINORS (Under 18 years old)

The undersigned parent and/or legal guardian does hereby represent that he/she is, in fact, acting in such capacity and is fully responsible and agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
